1. Acceptance of Terms

By downloading, installing, or using Scroll Sense, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the app. We reserve the right to modify these terms at any time. Continued use means acceptance of changes.

2. License & Usage Rights

What We Grant You

Scroll Sense grants you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes on iOS devices you own or control.

What You Cannot Do

  • Reproduce, modify, or create derivative works
  • Reverse-engineer, decompile, or disassemble
  • Use the app for illegal or harmful purposes
  • Attempt to gain unauthorized access
  • Sell, distribute, or license the app
  • Use automated tools to scrape or spam

3. Account Responsibilities

Your Account

  • You're responsible for all activity under your account
  • Keep your password confidential
  • Notify us immediately of unauthorized access
  • You warrant that information you provide is accurate and truthful

Age Requirements

Scroll Sense is intended for ages 13+. Users under 18 must have parental consent. We comply with COPPA and related laws.

4. Content & Intellectual Property

Our Content

The app, including all text, graphics, logos, images, and software, is owned by Scroll Sense. You may not use our content without permission.

Your Content

You retain ownership of content you create (journal entries, goals, notes). By using Scroll Sense, you grant us a license to:

  • Store and display your content in the app
  • Use anonymized/aggregated data for research and improvements
  • Backup and sync your data across devices

No Guarantee of Permanence

We store your data and take backups, but cannot guarantee permanent preservation. We recommend exporting your data periodically.

5. Prohibited Conduct

You agree not to use Scroll Sense to:

  • Harass, threaten, or abuse others
  • Post illegal content or engage in illegal activity
  • Spam or send unsolicited messages
  • Violate others' intellectual property rights
  • Disrupt the service or attempt unauthorized access
  • Use viruses, bots, or malware
  • Interfere with security features

6. Medical Disclaimer

Important: Scroll Sense is NOT a medical device or mental health treatment. It is a wellness app for self-awareness and habit building.

Not a Substitute for Professional Help

If you're experiencing serious mental health issues, please consult a qualified healthcare professional. Scroll Sense cannot diagnose, treat, cure, or prevent any disease or condition.

7. AI Features Disclaimer

Scroll Sense uses AI (Anthropic Claude/OpenAI) for content analysis. These features:

  • May contain inaccuracies or misinterpretations
  • Represent AI analysis, not professional assessment
  • Should not be relied upon for medical/therapeutic decisions
  • Are provided "as-is" without warranty

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: Scroll Sense and its creators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including loss of data, profits, or business interruption.

Our total liability is limited to the amount you paid for Scroll Sense (or $0 if free).

9. Indemnification

You agree to indemnify and defend Scroll Sense from any claims, damages, or costs arising from:

  • Your violation of these terms
  • Your violation of applicable laws
  • Your infringement of others' rights
  • Content you post or share through the app

10. Termination

We may suspend or terminate your account if you:

  • Violate these terms or our policies
  • Engage in illegal activity
  • Abuse or harass others
  • Attempt to harm the app or its users

Upon termination, your access is revoked, though you can export your data within 30 days.

11. Third-Party Services

Scroll Sense uses third-party services:

  • Firebase: Data storage and authentication
  • Anthropic Claude & OpenAI: AI analysis (optional)
  • Apple: Screen Time integration for app blocking

These services have their own terms and policies. We're not responsible for their conduct.

12. Jurisdiction & Disputes

These terms are governed by applicable US law. Any disputes shall be resolved in the appropriate court, or through binding arbitration if you agree.

You waive the right to a jury trial and class action.

13. Severability

If any provision of these terms is invalid or unenforceable, that provision is severed, and the rest of the terms remain in effect.

14. Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Scroll Sense regarding the app. Any prior agreements are superseded.
