1. Acceptance of Terms

Welcome to Scroll Sense ("we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Scroll Sense regarding your use of our mobile application ("App") and related services ("Services").

By downloading, installing, accessing, or using Scroll Sense, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App and should uninstall it immediately.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

Scroll Sense is a digital wellness application designed to help users develop healthier relationships with social media through:

• Tracking social media usage across various content categories
• Mood tracking and emotional awareness tools
• AI-powered content analysis and insights
• Journaling and reflection features
• Mindfulness exercises and wellness tools
• Goal setting and progress tracking
• Sleep health monitoring and correlations
• Data visualization and trend analysis

The App is intended for educational and wellness purposes only. It is designed to promote self-awareness and digital wellness, not to diagnose, treat, or cure any medical or mental health condition.

3. Eligibility and Age Requirements

Scroll Sense is designed for users aged 12 and older. By using the App, you represent and warrant that:

• You are at least 12 years of age
• If you are under 18, you have obtained parental or guardian consent to use the App
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us immediately. We will take steps to delete such information.

4. User Accounts and Registration

4.1 Account Creation

To use certain features of the App, you must create an account by providing:

• A valid email address
• A secure password
• Any other information requested during registration

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

4.3 Account Termination

You may delete your account at any time through the App settings. Upon account deletion, all your data will be permanently deleted within 30 days, as described in our Privacy Policy.

5. Acceptable Use Policy

You agree not to use the App in any way that:

• Violates any applicable local, state, national, or international law or regulation
• Infringes upon the rights of others, including intellectual property rights
• Is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempts to gain unauthorized access to the App, other accounts, or computer systems
• Interferes with or disrupts the App or servers connected to the App
• Uses automated systems (bots, scrapers) to access the App without permission
• Attempts to reverse engineer, decompile, or disassemble the App
• Removes or alters any copyright, trademark, or other proprietary notices
• Uses the App for any commercial purpose without our express written consent
• Impersonates any person or entity or misrepresents your affiliation

We reserve the right to suspend or terminate your account immediately if you violate this Acceptable Use Policy.

6. User Content and Data

6.1 Your Content

You retain ownership of all content you create, upload, or submit through the App ("User Content"), including journal entries, notes, and other data. By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and display your User Content to provide the Services
• Use your User Content to generate insights, visualizations, and reports
• Back up and maintain your User Content

6.2 Content Analysis

When you use our AI-powered content analysis feature, you understand and agree that:

• Content you submit (text or screenshots) will be sent to third-party AI services (Anthropic Claude API and/or OpenAI API) for analysis
• This content is not stored by us or the AI service providers after analysis completes
• Analysis results may be saved in your account for your reference
• You are responsible for ensuring you have the right to analyze any content you submit

6.3 Prohibited Content

You agree not to submit User Content that:

• Contains illegal, harmful, or offensive material
• Violates the rights of others (copyright, privacy, etc.)
• Contains personal information of others without consent
• Is spam, malware, or contains malicious code

6.4 Data Accuracy

You are responsible for the accuracy of all data you enter into the App. We are not responsible for any errors or inaccuracies in your data or for any consequences arising from such errors.

7. Third-Party Services

Scroll Sense uses third-party services to provide functionality, including:

• Firebase (Google): Authentication, cloud database, and analytics
• SendGrid (Twilio): Email delivery services
• Anthropic Claude API: AI-powered content analysis
• OpenAI API: AI-powered content analysis

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

By using the App, you consent to your data being processed by these third-party services as necessary to provide the Services.

8. Intellectual Property Rights

8.1 Our Intellectual Property

The App, including its design, features, functionality, code, graphics, text, and all other content, is owned by Scroll Sense or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for personal, non-commercial use, subject to these Terms.

8.3 Your Intellectual Property

You retain ownership of your User Content. You grant us only the limited license described in Section 6.1 to provide the Services.

9. Disclaimers

9.1 Service Availability

We strive to provide reliable service but do not guarantee that the App will be available at all times, error-free, or uninterrupted. The App may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

9.2 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components

9.3 AI Analysis Disclaimer

Our AI-powered content analysis feature uses third-party AI services. While we strive to provide accurate insights, we do not guarantee the accuracy, completeness, or reliability of AI-generated analysis. AI analysis is provided for informational purposes only and should not be considered professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCROLL SENSE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from reliance on information provided by the App
• Damages resulting from third-party services or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Scroll Sense, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting your account through the App settings or by contacting us at support@scrollsenseapp.com.

12.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent, illegal, or harmful activity
• We are required to do so by law
• We discontinue the App or Services

12.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All your data will be deleted in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 9, 10, 11, and 13.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing a claim, you agree to contact us at support@scrollsenseapp.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

13.3 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California, United States.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scroll Sense regarding your use of the App and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

14.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet failures.
